Welcome to Sing Out Love! These Terms & Conditions (the "Terms") govern your access to and use of our virtual hymnal application and website (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, please do not use our Service.
1. Acceptance of Terms
By creating an account, accessing, or using Sing Out Love you affirm that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and representing that you have the authority to bind that organization to these Terms.
2. Your Account
a. Account Creation
To access certain features of the Service, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
b. Account Security
You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to comply with these security obligations.
3. Use of the Service
a. Permitted Use
Sing Out Love grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, in accordance with these Terms.
b. Prohibited Conduct
You agree not to:
- Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
- Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service without our express written permission.
- Modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the Service.
- Remove any copyright, trademark, or other proprietary rights notices contained in or on the Service.
- Transmit any worms or viruses or any code of a destructive nature.
- Interfere with or disrupt the integrity or performance of the Service or data contained therein.
- Attempt to gain unauthorized access to the Service or its related systems or networks.
c. User Content
If the Service allows you to create, post, or store content (such as notes, bookmarks, or custom hymn lists), you are solely responsible for that content. You retain ownership of your content, but you grant Sing Out Love a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, distribute, and display such content solely for the purpose of operating and providing the Service to you. You warrant that your content does not violate any third-party rights, including intellectual property rights or privacy rights.
4. Intellectual Property
All content, features, and functionality within the Service, including hymns (where applicable and licensed), text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and the arrangement thereof, are the exclusive property of Sing Out Love or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
5. Disclaimers and Limitation of Liability
a. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. Sing Out Love does not warrant that the Service will be uninterrupted, secure, or error-free.
b. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Sing Out Love, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
6. Indemnification
You agree to defend, indemnify, and hold harmless Sing Out Love, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Service.
7. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of your Country/State, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in your City, Your State/Country.
8. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Service. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
9. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
